Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the https://www.homerun.co.uk website (the "Service") operated by HomeRun ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Platform you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Platform.

Additional Terms and Policies

Please review HomeRun’s Privacy Policy, for information and notices concerning HomeRun’s collection and use of your information.

Key Terms

"Platform" means https://www.homerun.co.uk website and IOS / Android Mobile Applications,

"User" means a person or entity using the Platform for any purpose

"Member" means a person or entity who creates an account with a username and password via accepting the Terms.

"Service Profile" means the profile that the Service Provider creates on the Platform to describe and present the type of service(s) s/he provides, receive Customer Requests and Send Quotes.

"Customer" means a Member who is registered to receive quotes from Service Providers for his/her Service Request.

"Service Provider" means a Member who is registered to send Quote(s)

"Service Request" means a request submitted on the Platform by a Customer to receive Quote(s) from Service Provider(s).

"Quote" means the price of the service that the Service Provider sends to the Customer as an offer.

"Lead Cost" means the amount that the Service Provider needs to pay to HomeRun in order to send a Quote to the Customer for the Request.

"Job Deal" means the status of the Request if the Customer or the Service Provider confirms that the parties have a deal between.

"Commission Fee" means the price that HomeRun defines and is entitled to collect from Service Providers upon a Job Deal.

"HomeRun Balance" means the amount of money that the Service Provider has on the Platform in order to be able to send Quotes or pay Commission Amounts.

"Gift Voucher" means the gift amount added to Service Provider’s Account Balance by HomeRun for promotional purposes.

Creating an Account and Using the Platform

HomeRun is a technology platform that enables Customers to find independently-established Service Providers for their service Requests.

Users may access the Platform free of charge without a requirement of account registration. In order to access and/or use certain features of the Platform, you will need to create an account with a username and password.

Only individuals over 18 years old may create an account with us. By creating an account on the Platform, you represent and warrant that you are eligible.

You are responsible for safeguarding the password that you use to access the Platform and for any activities or actions under your password, HomeRun is not liable for any losses by any party caused by an unauthorized use of your Account. In addition to this, you may be liable for the losses of HomeRun or others due to such unauthorized use.

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your accounts on our Platform. In addition to this, you may beliable for the losses of HomeRun or others due to providing such inaccurate information.

HomeRun is not a Service Provider. It is a technology platform enabling Customers and Service Providers to reach out to each other for a service need. Customers understand and agree that HomeRun does not guarantee that they will receive a Quote from a Service Provider for their service Request. Likewise, Service Providers understand and agree that HomeRun does not guarantee that the Quote they send to Customers will become a deal.

The Service Provider upon creating an Account on the Platform represents and warrants that they are qualified, certified, licensed, and insured as required by applicable laws or regulations to which they may be subject in the jurisdictions in which they offer service and in relation to the specific job they perform.

Service Providers understand and agree that creating an account on the Platform does not mean they become employees, partners, agents, or representatives of HomeRun. They acknowledge that they set or control their own prices, use or provide their own equipment, and manage their own calendar.

Taking the necessary precautions to provide a safe workplace is the Customer’s and the Service Provider’s responsibility. HomeRun is not liable for any accidents and related losses that occurred due to the absence of these precautions.

User Content

Users acknowledge that they are solely responsible for all content, such as idea, suggestion, explanation, research, offer etc., that they share on the Platform.

HomeRun does not have an obligation, but reserves the right for any reason, to monitor, review or guarantee the accuracy, quality, suitability or completeness of any User Content contained or presented on the Platform. HomeRun is a mediary and it is never liable to research the User Content and its compliance with the laws.

HomeRun reserves the right to remove or disable access to User Content or terminate a related Member account that is in violation with the Terms and/or harmful to the Platform, Users, and Member, at any time and without prior notice. This violating content and/or activities contains or features any of the following but not limited to:

I. Racist discourse, hate speech against any group or person,
II. Defamatory, insulting, harassment or advocating harassment,
III. Sexually explicit language,
IV. Praising illegal & terrorist activities,
V. Content that disparage HomeRun,
VI. Creating jamming or spamming content,
VII. Encourages illegal or unauthorized copying of copyrighted work,
VIII. Pages or content from prohibited or password-protected pages,
IX. Content with sexual or violent material that exploits individuals under the age of 18, content or requesting personal information from an individual under the age of 18,
X. Providing instructional information about illegal activities, such as the manufacture or purchase of illegal weapons, the violation of someone else's privacy, or the delivery or creation of computer viruses,
XI. Requesting password or any personal information from others for commercial or illegal purposes,
XII. Involving commercial activities and/or sales such as contests, sweepstakes, barter, advertising and pyramid scheme without our prior written consent,
XIII. Recording, disseminating, misusing the personal information of others,
XIV. Violate the intellectual and industrial rights of third parties such as trademarks and patents,
XV. Including unfair trade practices and limiting competition, and
XVI. Violating national and/or local consumer protection laws.

The Members acknowledge and agree that the content of the profile created on HomeRun will be indexed by various search engines, that search sites can be viewed by the general public, third parties and institutions; and Members are solely responsible for the information they shared on their profile.

HomeRun Balance, Fees and Payments

Regarding the use of the HomeRun Platform, HomeRun may charge some fees (Lead Cost, Commission Fee).

Service Providers make payments to HomeRun in order to reach out to Customers and get jobs. Service Providers can transfer money to their HomeRun Balance with the credit or debit card payment. By doing that they understand that HomeRun may charge their HomeRun Balance when they send a Quote, i.e. Lead Cost, to a Request and/or when they have a Job Deal, i.e. Commission Fee. Lead Costs and the Commission Fees, if/when there is a Job Deal, are clearly provided to the Service Providers before submitting the Quote.

Service Providers may send Quotes to Customers, contact Customers, make a discovery visit and/or additional expenses for the services they offer until getting a Job Deal. The Service Providers acknowledge and agree that HomeRun does not guarantee a job deal for any Quote. The customer may not see the Quote, may cancel the Request, may choose someone else to work with. The Service Provider cannot claim a refund for the Lead Cost in any of these cases. Service Providers also acknowledge and agree that they are solely responsible for determining their own tax reporting and sales and use tax collection requirements.

Gift Vouchers defined by HomeRun to the Service Providers’ HomeRun Balance have no intrinsic and cash value and they are not redeemable for cash. The Lead Costs and/or Commission Fees are charged from the HomeRun Balance with the following order: First from the Service Provider’s payments, then from the Gift Voucher amount defined by HomeRun, if any. HomeRun reserves the right to cancel these Gift Vouchers at any time.

Customers make direct payment to the Service Provider after the service is performed, regarding the total service fee for the Quote they choose. Customers should request the invoice, sales receipt or delivery note of the service fee they have paid from the Service Provider. Customers cannot request these documents from HomeRun, as Homerun does not perform and is not responsible for any of the Services requested by the Customer.

Quotes from Service Providers and/or Job Deal information provided by Customer or Service Provider on HomeRun Platform are for informational and communicational purposes and binding, Customers should make a written contract with the Service Provider, and if they make an advance payment, they should obtain and keep their document or receipt.

Unless, otherwise stated in the contract signed between Customer and Service Provider, Customer has the right to cancel the project without any justification and without any penal clause provided that the service has not been performed and the service has not started yet. In this case, the payments made will be refunded by the relevant Service Provider and cannot be requested from HomeRun.

Customers and Service Providers acknowledge and agree that HomeRun does not have any responsibility in disputes that may arise between the Service Provider and the Customer regarding payment, service cancellation, discount or refund.

Tracking Communications

In order to prevent inappropriate messaging and maintain quality and secure service, HomeRun may store and analyze the communication between Service Providers and Customers by using call and messaging data between them. HomeRun reserves the right to use inappropriate contents as evidence in courts if requested by laws.

Disputes Between or Among Members

HomeRun values its Customers and Service Providers, and understands that occasionally disputes may occur between or among these parties. HomeRun aims to provide tools to help these parties to resolve such disputes independently. All members acknowledge and agree that HomeRun has no obligation to be involved in or impose resolution in any dispute between or among members or any third party.

Customer or Service Provider cannot write any comments for the job Requests that they never received or provided, and/or they cannot provide any content about someone else’s business products, services and trade name in a way that creates unfair competition.

If an investigation or prosecution is initiated for any criminal behavior against either the Service Provider or the Customer before, during or after the service provided, HomeRun may share all information and documents in its possession with the relevant judicial authorities upon request.

When communicating with each other or with HomeRun employees, Service Providers and Customers cannot use offensive and/or abusive language and/or content, including without limitation: racist discourse, hate speech against any group or person, defamatory, insulting, harassment or advocating harassment, praising illegal & terrorist activities, creating unfair competition, sexually explicit language. When detected such behaviour, HomeRun reserves the right to immediately terminate and/or edit related accounts and/or content, without prior notice, and may report this situation to the official authorities if needed.

Links To Other Web Sites

Our Platform may contain links to third-party web sites or platforms that are not owned or controlled by HomeRun.

HomeRun has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or platforms. You further acknowledge and agree that HomeRun shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or platforms.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or platforms that you visit.

Intellectual Property Rights

HomeRun has the ownership and license of all intellectual property rights in the Platform and in the visual and/or written materials (including but not limited to: domain name, logo, graphic, text, image, html code, other codes, demonstrative, written, electronic, graphic or technical data) published on it. HomeRun is a registered trademark. All rights in this trade mark, the HomeRun domain name and all related domains and subdomains and any other logos, service marks, brand names, trading names and/or trade marks appearing anywhere on the Platform are reserved to their respective owners or licensors.

Members acknowledge and agree that they have no rights in or to HomeRun or the technology used or supported by the Platform other than the right to use it in accordance with these Terms. Members acknowledge and agree that if they use any part of HomeRun in breach of these Terms, HomeRun reserves the right to terminate your access to the Platform.

Termination

We may terminate or suspend access to our Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Platform, and supersede and replace any prior agreements we might have between us regarding the Platform.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Platform.
